Jackson Pleads Innocent on MolestationBy LINDA DEUTSCHAP Special CorrespondentSANTA MARIA, Calif. (AP) -- Michael Jackson pleaded not guilty Friday to a grand jury indictment charging him with child molestation and a conspiracy count involving allegations of child abduction, false imprisonment and extortion.The indictment also included four counts of lewd acts involving a minor child, one count involving an attempted lewd act upon a child and four counts of administering an intoxicating agent to a child.The alleged child abduction, false imprisonment and extortion are not individual charges. Rather they are alleged as the circumstances leading to the conspiracy count.After being given copies of the indictment, Jackson and his attorneys went into a room next to the courtroom to read it.Superior Court Judge Rodney Melville then agreed to a prosecution request that portions of the indictment regarding the conspiracy count be sealed. He also agreed with a defense request that parts of three lines be removed.In brief comments afterward, Thomas Mesereau Jr., Jackson's new attorney: "This case is about one thing only. ... the complete vindication of a wonderful human being named Michael Jackson."Jackson thanked his fans for their support and said Santa Maria was a "wonderful" community.The indictment, issued in secret earlier this month, replaces charges filed by prosecutors that alleged seven counts of lewd or lascivious conduct involving a child under 14 and two counts of administering an intoxicant to a child under 14.Copies of the indictment, with the requested deletions, were not immediately released to the public, and it was not known whether the new charges involved the same child mentioned in the original charges, or what the conspiracy and extortion counts referred to.The judge said the transcripts of the grand jury proceedings would be turned over to attorneys Monday but will remain under seal. He said he will hold a hearing on the sealing May 28. Jackson waived his right to a speedy trial.Mesereau, a veteran criminal defense attorney, took over the case last weekend after Jackson decided to remove Mark Geragos and Benjamin Brafman, the two high-profile lawyers who had been directing his defense. And don抰 get me started on his skin treatments, chin, eyes, hair and sundry other nips and tucks that have taken place during the King of Pop抯 reign.His musical career has traveled along a similar avenue of alterations. There are distinct differences in tone and style from 揙ff The Wall?to 揟hriller" to 揃ad,?and so on. Mike knows his fans are out there, eager for his next move, be it creative or cosmetic. He lived by the axiom, 揑mage is Everything?long before Nikon and Andre Agassi hijacked it for a marketing campaign. Whatever Mike lacks in street cred these days, he more than makes up for it in Madison Avenue savvy.So it抯 no surprise that Mike is on top of these latest developments in his child molestation case. Well before a grand jury indictment was handed down, well before his arraignment took place Friday in Santa Maria, Mike had his image makers in full battle station mode.Of course, Mike is not without flaws. In his first court appearance on January 16, he danced atop an SUV as his fans cheered. And that was after he showed up 20 minutes late and was scolded by a judge.Once Mike experienced a backlash from this, he quickly realized that projecting an image of a superstar entertainment icon who is as blas?about accusations of child molestation as he is about getting a parking ticket on his limo is an imprudent course of action. He quickly wised up.On Friday, he arrived 40 minutes early to court. Just getting up that much earlier for makeup illustrates his new commitment.After Friday抯 proceedings, he made a brief statement. 揑 love the community of Santa Maria very much,?he said. These two should get along swimmingly.In addition, Jackson has lessened the role of the Nation of Islam in his life. Reportedly, members of the Nation of Islam started off providing security, but soon they were running every aspect of Mike抯 life. The Nation抯 influence became so strong, some of Mike抯 llamas at Neverland Ranch were seen wearing bow ties. Realizing that he someday might be forced to sing a duet with Louis Farrakhan, Mike put his foot down.Always with image in mind, Mike went back to his roots. He brought in family members, and is now said to be listening mostly to his brother Randy. Any embracing of family members is considered good marketing for Mike in a situation like this. It抯 the embracing of another family抯 members, especially children, that should be avoided at all costs.The charges, of course, are powerful and not to be taken lightly. Jackson抯 indictment accuses him of child molestation and a conspiracy count involving allegations of child abduction, false imprisonment and extortion. Many of the details were kept under seal, and the public may not hear them until trial, although leaks are usually as abundant in these situations as cameras and microphones.Because of the grand jury indictment, a pretrial hearing is not necessary. This is a blow to Mike, because it denies him another opportunity to demonstrate his new image. But the judge in the case will hold another hearing on May 28 to discuss the sealing of the details of the indictment, so expect Mike to work up a new act between now and then. They'd also been reported earlier in People and The National Enquirer, but that's another story. Much has been made of some kind of secret club Jackson may have had called the "Rubbaheads," which had typed rules and regulations. A note to other Rubbaheads was found in the Jackson family storage bin purchased by a man in New Jersey. There's an implication that because Jackson called some boys "Rubbas," it connotes any number of unseemly things. So, I asked one of the boys, now grown, about the alleged Rubbahead Club of 10 years ago, when all this happened. He says when he heard about all this a few weeks ago and again yesterday, he was stymied. "First of all, there was no Rubbahead Club. Rubba was a name Emmanuel Lewis, who played Webster, came up with. Everyone called everyone Rubba. It didn't mean anything. What we did have was the Applehead Club, and that was from 'The Three Stooges.' Everyone was an Applehead because Michael loved 'The Three Stooges.'" This was 10 years ago, when a number of well-known 13-year-old boys were coming and going from Neverland. They included Macaulay Culkin, Wade Robson, Lewis, the young man I spoke with and the young man from the Jackson case 10 years ago. "It's nothing sexual," my source continued. "Michael even called one of the younger kids Baby Rubba. It didn't mean anything." So what about the typed list of rules found in the storage bin? They included requiring members to be "idiots and act crazy at all times"; be vegetarians who fast on Sundays and avoid drugs; watch two episodes of "The Three Stooges" daily; know the Peter Pan story by heart; and when seeing another member, "give the peace sign, and then half of it." In fact, insists my source, "there were no rules at Neverland. The whole thing was about not having rules and having a good time. It was all from Peter Pan. There was no club, no initiation, and I never heard of a 'club kit' or anything else." What's clear about all this is that, when witnesses are called in the Jackson trial next winter, many things will be left to interpretation. What may seem prurient to the public on first impression may turn out to be completely innocent. It will be up to Jackson's lawyers to help a jury understand that. Ironically, there was a serious misinterpretation in yesterday's reports about the meaning of a poem by Henry Wadsworth Longfellow called "The Children's Hour." In the poem, the narrator addresses three little girls, not little boys, which was the impression given in the reports. Conspiracy TheoryProsecutors Focus on Two Longtime Jackson Associates in New ChargeMay 3 ?At his arraignment Friday, Michael Jackson learned that he was facing a new charge of felony conspiracy in the child molestation case against him and ABCNEWS has learned that prosecutors are focusing on two long-time associates of the "King of Pop."Jackson, 45, has pleaded not guilty to 10 charges that include felony conspiracy with 28 overt acts involving child abduction, false imprisonment, extortion; committing lewd acts upon a child; attempting to commit a lewd act; and administering an intoxicating agent to a child. In the felony conspiracy charge, prosecutors have focused on Vinnie Amen and Frank Tyson, who both worked for Jackson at his Neverland ranch, ABCNEWS has learned.Sources familiar with the case told ABCNEWS that Amen and Tyson are accused of using pressure tactics to try to silence the family of Jackson's alleged victim. The alleged victim's family says that Amen and Tyson, under Jackson's orders, threatened the boy's brother and allegedly said they would have him and his family killed if they revealed any information about the singer sharing alcohol with them. Jackson has been accused of serving his accuser wine in soda cans.According to the attorney for Amen and Tyson, Joseph Tacopina, the two men also have been accused of taking the alleged victim's siblings out of school, getting passports for the family and pressuring them to leave the country. Amen and Tyson were offered partial immunity to testify before the grand jury that decided to bring charges against Jackson, but both rejected the deal.Pressure Tactics ?by the ProsecutionTacopina said his clients deny the allegations against them. Henry V. Vaccaro Sr., the man who wanted to sell a large collection of Jackson family memorablia a few weeks ago, has turned over a pair of underwear and other items to authorities investigating the Michael Jackson child molestation case. He said he found the white Calvin Klein briefs balled up in the bottom of a wardrobe containing several of the pop star's costumes. The briefs and several newspapers were seized several weeks ago by the Monmouth County Prosecutor's Office at the request of California authorities. Robert Honecker, the county's first assistant prosecutor, confirmed that his office collected the evidence but declined to say why the items were sought. A spokesman for the Santa Barbara District Attorney's Office declined to comment, citing a protective order issued by the judge presiding over the pop star's case. Vaccaro said he was told that authorities plan to use the underwear for DNA comparison."Once we secured the items, we notified the district attorney's office," Honecker told The Star-Ledger of Newark. "They sent two detectives out and we turned the evidence over to them." Vaccaro said two Santa Barbara sheriff's officers later returned to his warehouse and "they found a few other things they were interested in," including two handwritten notes from Michael and a list of "rules" children had to follow when staying at the Neverland Ranch in Santa Maria, California. 美联社

In charging Michael Jackson last week with conspiracy, Santa Barbara County District Attorney Tom Sneddon turned to a favorite tool of prosecutors confronted with difficult cases, an allegation that focuses on a plan to cover up a crime, legal experts said. "The conspiracy charge is the darling of prosecutors," said Loyola University law professor Laurie Levenson, a former federal prosecutor. "It's fairly easy to prove and you only need a concerted action, not an express agreement. The conspiracy means the crime didn't necessarily happen but there was a plan for it to happen." Thus, she said, Jackson could be acquitted of molestation charges but convicted of conspiring to abduct the child and his family, falsely imprison them and commit extortion by threatening grave consequences if they accused him. "It's not the crime you commit. It's what you do to cover it up," said Levenson. Those allegations were specified in the Jackson indictment as being among 28 overt acts involved in the conspiracy charge. Asked how the indictment affects Jackson's future, Levenson said, "He is in a heap load more trouble than he was yesterday. This is a much more serious case today than it was yesterday. The only hope for the defendant is that the prosecution overreached and exposed more weaknesses in their case." The listing of 28 overt acts in the conspiracy sounds overwhelming but the acts may be as simple as a phone call or a conversation with someone. And the prosecution need prove only one overt act to prove its case. "One reason the judge may not be releasing the overt acts could be that they contain information intended only to dirty up the defendant. They may not be provable," said Levenson. "It's not a conspiracy to molest," Levenson stressed. "It's a conspiracy to cover up. A cover-up can show a guilty conscience, and even if there is no molestation he could still be convicted." Another legal source said that the conspiracy allows the prosecutor to lay out the theory of his case, step by step, providing jurors with a roadmap to the evidence. The time period can be broad and hearsay evidence can be used. The source suggested that Sneddon is relying on it because evidence supporting the molestation counts is weak. The conspiracy charge gives the case a new aura, Levenson noted. "It takes it beyond an act of molestation to a criminal plot. It makes it much more dramatic."

a FAN "vstreet" report:Got back from Santa Maria and here's my report (Disclaimer for all of those "eyes": This report is based strictly on my opinion, unless otherwise expressly stated below): The PoliceI could NOT believe how many police were patrolling out in front of Neverland on Thursday and Friday. These cops were literally waiting for someone to sneeze so that they could issue a citation. And talk about the biggest bunch of redneck cops – they would NOT even smile or say hi in return. They would literally look through you. I did NOT observe any brutality or “misconduct” on the officer’s part, but I did witness one resident of Santa Maria get arrested after the cop asked him to turn off his radio which was playing MJ music on 95.7. The cop gave him 3 rapid warnings and then confiscated his license and told him he was going to jail. SB County cops were all white, as far as I could tell. The Santa Maria police dept on the other hand had some diversity. These assholes had nothing better to do than drive up and down the road in front of MJ’s property. For a minute, I thought I was in a gang war zone by the way the cops were patrolling the area. Cops patrolling Neverland like there was no tomorrow – there’s NO DOUBT we live in a military police state. My Conversation with Agent BW (following has been paraphrased and the person’s identity has been concealed in order to protect his privacy if he so wishes to keep his opinions private) -- I noticed that some of the people on this board have already started discussing himI went into a very detailed discussion with BW. For those of you who do NOT know him (or those who were not there during our conversation), BW is a local SB County resident and is an independent investigative journalist who provides programming to an independent network which is available on Satellite. He is also a major political activist in the area and constantly confronts govt. corruption (in whatever ways he is able to). He has also done a show about MJ's legal case and claims that he wish he could do more, but the govt. is trying to shut him down. I asked BW what he thought of the current legal situation: He said that it was a very well known fact that Tom Sneddon is furious about Michael’s song D.S. He said that he never got over that and the fact that MJ “got away” in 1993 and Sneddon was “out to get him”. He also said that he warned Michael about this “plot”. I asked his opinion of Judge Melville: He said he knows Melville very well and knows that he rides horses (who doesn’t in SB County?) and is a “good ole’ boy”. He said that he is one of Sneddon’s buddies (as are a lot of “elites” in that area). He said that Melville will NOT be fair to Michael and that he is probably one of the WORST judges (in his opinion) that he could have been given. He also made the comment that Melville was handpicked for this case and that the other judges were mysteriously assigned to other tasks in order for Melville to look like he was the only one that could handle this. He said that Melville will “screw MJ into the ground” on judgment calls that he has to make. Remember, judges have to use the law to make fair & impartial decisions. Well, according to BW, Melville will almost always make the worst decision (in the prosecutions favor) for Mike. When asked who he recommended as an alternative to Melville, BW said Zell Cantor and another judge whose name I cannot remember. Zell presided over the Avram lawsuit against Mike in 2002. He said that there really isn’t going to be a “fair” judge in that county, but if push came to shove Zell and one other one would at least not be as harsh as Melville or some of the others. (he has had some experience with almost all of the judges in SB County)I asked BW about the Grand Jury in the current case: He said that he staked out the Grand Jury’s locations and saw the Grand Jury. He claims that the Grand Jury was selected only from the North County and that they were all white. He said that they were ready to indict MJ from day one. I asked BW about the Conspiracy charge: BW said that this was going to be the count that they will get MJ on. He said even if MJ were to avoid being convicted on all other counts, it will be nearly impossible to escape this one count because it really doesn’t require hard evidence per se and it allows “hearsay” to be introduced. He said practically anybody can be called as a witness for the conspiracy charge and it only takes a little to make you guilty of this (even if you didn’t commit the crime itself – you can still be guilty of a coverup). It can also affect MJ’s attorney client privileges. Plus, he said that juries in the North County (which are predominately neoconservative and white) tend to believe that if the Govt. charges you with a crime, then you must have done something wrong. He said that this charge was going to be the “easy” one to “get” MJ on. I asked BW about his opinion of what he recommended Mike should do at this point: He responded that Mike should hire a couple of helicopter pilots and get the hell away from SB County. He said that although he didn’t consider Michael “normal”, he definitely doesn’t believe Michael is guilty of any of the charges against him. When asked why he doesn’t dig up the dirt on the county and present this in a new show, he said that he would, but that would cause him to get into trouble with law enforcement. According to BW, law enforcement doesn’t like him cause he is a “whistle blower” and a Libertarian. He mentioned how “THEY” were trying to shut him down for good. The People of SB CountyI questioned many people of the local area on what they thought of MJ and his case. The reason I did this is to gauge what the average person on the streets of SB County thinks of MJ. I met a fan who was a long time resident of SB county and she said that the majority of the area does NOT like MJ. She constantly gets threatening glares from locals when she wears MJ shirts and they make it very obvious that they do NOT like MJ by giving her their opinion of him. (note, although I did not receive any threatening glares, I did not receive any warmth either. I did get a few eye rolls from people who were driving by Neverland Ranch, but I also saw a considerable number of locals yelling out support chants and playing MJ music)I met an elderly woman at the front gate of Neverland. She was probably in her 70’s. She said that she felt MJ never did anything wrong and she had a favorable opinion of him because he did a lot in the way of philanthropy for the local community. She did not understand the current case against MJ. I met several other fans from the area, but one in particular told me about a rally she had at her school. She said that she cleared it with her teachers and that although she had a lot of people questioning her and some that were NOT happy, it was overall positive. She said that the support rally for Michael had some effect on the mindset of the students to at least start asking questions of the case. In Santa Maria, I ran into many residents who claimed that they were just there observing the court house that day because they had heard about it in the media and wanted to come down to see what it was like. They also said that they had not made up their minds about Mike and that they would wait and see what happens. One person also said that his gut says something must have happened for this to go down the way it did. A convenience store worker (who was Hispanic) asked me what MJ was like. She seemed very amazed that I got to see MJ and sounded positive in her opinion of MJ, but could not give me a definite answer as to what she thought of the case. She responded, “I don’t know”. I talked to a local DJ for 95.7 in Santa Maria and he said that his station supported MJ as an artist (cause they play his music all the time – even before the charges), but could NOT comment on the legal case as they have to remain neutral. He was in the crowd of fans at the court house and sounded genuine. I also ran into some of Sneddon’s cohorts outside of the courtroom holding up that sh*tty sign that says that “they believe the victim” and that “they support their DA and sheriff. There were approx. 4 ladies in total and they all had on some cheap shirts that they all printed up and were the same ones who were at the other court appearances. They got booed and cussed out by the crowd, but the media still paid more attention to them than they deserved. I actually went up to one of them and asked her who paid her to hold up that sign. She rambled off some scripted response as to how the county of SB elected Tom Sneddon and how she supports him and that the residents like him. It was total BS and it looked like she knew it, too. In Solvang (which is predominately Danish), I ate at a restaurant where I overheard whisperings of MJ at a table near me. I couldn’t make out what was said, but I did hear Michael’s name and I know that the family was discussing him. I also overheard one resident exclaim to the other that the reason he came “out to eat” was because his maid had quit. I just found that comment surprising since I wasn’t used to hearing about people having their own maids. I guess I just live in the wrong area of the Country. The Local Santa Marian Media:The Santa Marian SUN newspaper (dated April 29, 2004, page 27) stated that the best way to prepare for the MJ Trial is to treat the trial like a “Biological” terrorist threat and visit the Department of Homeland security’s website to prepare for it. It goes on to make comparisons between the govt’s tips on how to prepare for Biological Hazard and the MJ case (essentially telling the reader to follow the govt’s tips to prepare for the trial). What I predict will happen (This is my opinion) Michael Jackson is the target of a Neoconservative movement in the country. I’m not going to get into what being a NeoCon is about or who they are (there’s plenty of information on the internet), but I can summarize it by saying that they have a very far reaching, broad based plan which is currently being executed (i.e. the clean up of the Priesthood, the war on drugs, the war on Terrorrism, the crackdown on DISSENT in the media, the crackdown on left wing radio or any broadcast that is considered “indecent”, the crackdown on anyone who fights with Big Business or attempts to “break away” from Big Business’ control, etc.). Michael Jackson (and those like him) are NOT a part of the NeoCon plan. He is a threat to the overall function of this plan. Neocons do NOT support Black individualism or Black power for that matter. (I believe Sony has influenced this county’s decision to persecute Michael) If Michael sticks around for a trial (which is more like a Tribunal since his attorney client privileges will be breached and they will allow “hearsay” evidence into the trial) he will be railroaded on the FALSE charge of Conspiracy. SB County (particularly those in Santa Maria) juries consists mainly of upper white class conservatives who generally believe that if the Govt. charges you with a crime, then you must have done something wrong. Conspiracy is a very easy charge for a prosecutor to win since it allows the defendant’s rights to be further breached by allowing in “hearsay” evidence. Basically, anyone can come forward with his/her own version of events (even if they are third party “he said, she said” information) and state something for the jury to hear. Furthermore, the juries in “neoconservative” Santa Maria are carefully selected by prosecutors so that they get their conviction. Mike’s house is almost the same distance from Santa Maria as it is from Santa Barbara. The only reason Sneddon chose the North County to try Mike is so that he is tried by a bunch of govt. drones.Furthermore, the conspiracy charge is a Federal felony. Don’t expect Mike to get any help from the FBI or CIA. They are in on this together. Just take a look around and see how many people with ties to the govt. have had a hand in “creating” this case (Xtrajet, Jay Jackson, G**** and his siblings who were part of several law enforcement youth programs, Masada who had connections to an assistant DA who served as his bouncer for almost a decade, etc.). Just take a look at the timeline between January 1, 2001 and May 3, 2004 and see all of the peculiar incidents (and DA statements) that have cropped up. Don’t forget Roger Friedman’s ominous warning in the Summer of 2002 of how MJ and all of his associates were going to be destroyed in a “scorched Earth” scenario. I have always said that this case is MUCH MUCH bigger than you can imagine (remember how I told you that we needed to “connect the dots” in this case to understand who all was involved?). There are conspirators galore trying to destroy MJ and all of his associates. I also believe that this current plan (which includes G****) was hatched in 2001 (before the release of invincible). Sneddon said that the 1993 case was NOT dead and that it could be reactivated upon a new accuser coming forward. When Mike said that his "life" was at stake, he wasn't lying. I believe he means that "literally". Furthermore, T-Mez should NOT have complimented the judge in this case. This judge does NOT deserve to be complimented. Due to his comments, I have my reservations about T-Mez. I will refrain from further comment until I get a better grip of what he is like. There is NO Doubt (not even .000005 %) that MJ is Innocent. There is NO Doubt (not even .000005 %) that MJ is Innocent. And unlike BW, I believe MJ is NORMAL and is an OUTStanding Soul. He is divinity in motion.

But when?It's a recurring question in celebrity journalism, where gossipy tidbits are a way of life. "Too much" is a judgment call, it seems, particularly in such situations as Michael Jackson's, where the usual vignettes about Hollywood foibles pale in comparison to the serious nature of the charges against him.The singer pleaded not guilty last week in a California courtroom to 10 counts related to the alleged molestation of an underaged boy.It was Jackson's first court appearance since January, and developments in the case have been few between then and now. Yet the media attention has been constant since Jackson was arrested last November, with constant updates in the press."High-profile (cases) garner interest," says Marlene Dann, senior vice president of daytime programming at Court TV, which keeps close tabs on the saga.Covering legal matters is Court TV's raison d'etre, but the sordid affair has become a bit much for some news outlets."It's being played out so much in the rest of the press, there's really no real reason or hunger for us to do it," says Marc Malkin, news director of Us Weekly magazine. "(People) get it enough on TV and in the daily papers, and every day, it's just one piece of minutiae that's changing. And it's a downer of a story. We're talking about a superstar who is allegedly fiddling with children. That's not really an Us Weekly story - we're a happy magazine."Malkin says Us Weekly will monitor the story and write occasionally about it as events merit."Every once in a while, if there's some huge shattering news, we might blow it out a little more, but you're not going to see it in depth," Malkin says.That approach contrasts with the National Enquirer's, where there is a hunger to blanket the story. The Florida-based weekly tabloid has broken stories on the Jackson case for months, and editor in chief David Perel says he has no intention of letting up."As we go forward, we're going to continue to investigate the case and try to get behind the scenes, and we'll go wherever the news takes us," Perel says. "This is really an area that we excel at, and we're going to keep the pressure on."That pressure so far has resulted in scoops that the brother of Jackson's alleged victim is said to have witnessed misconduct, and that Jackson allegedly served wine in soda cans to children. Perel says the Enquirer has about 10 reporters at any given time investigating both sides of the case. Even so, he says, the paper must be careful not to wear out readers."If you're just running stories for the sake of running a story every week, that's not going to work. We've been fortunate in that we've been able to gather news every week to advance the story," Perel says.Each media outlet caters to a different audience, and coverage of the Jackson case reflects that. But is the prosecution actually walking into an ambush by pursuing this self-proclaimed “case” in this way? Some say that with the added conspiracy charge, it is indeed indicative of the fact that prosecutors haven’t been able to find any corroborating evidence of the underlying charges of molestation and the administration of alcohol.Many legal experts see this charge as a plus for the prosecution because they can now bring in hearsay information that otherwise wouldn’t have come up. But what they fail to point out is that this, too, can be a major plus for Jackson’s defense team.Sources say Jackson’s defense team may have truly been expecting a charge like this and could have been preparing a defense for it long before the charges were read during the April 30 2004 hearing. By taking the “case” in this direction, prosecutors may be allowing Jackson’s defense team to also bring in evidence that otherwise may not have been allowed in court. Also potentially damaging is the fact that Santa Barbara Sheriff’s Department (SBSD) did their own 2 month investigation into allegations around this very family. That investigation lasted from Feb 18 – April 16 2003, according to media reports. Remember, the prosecution is alleging this “conspiracy” ended March 31 2003. That investigation turned up absolutely nothing: “no criminal activity”, no complaining witnesses and no other allegations.What’s also important to note is the fact that alleged “co-conspirators” usually don’t “flip” (turn on) the main defendant if they can actually prove they did nothing wrong. This is not comparable to what happened in the Martha Stewart case or the Jayson Williams case, although you will see comparisons to the two trials. The convoluted allegation—coupled with the suspicion of some of Jackson’s employees of this family’s motives very early on—will all but guarantee that this conspiracy charge won’t be as cut-and-dry as in those two cases. This is an incredible gamble by the prosecution that, sources say, will end up blowing-up in their faces.Soon we will see if the prosecution has played right into the defense’s hands by pursuing this kitchen-sink charge of conspiracy. A charge which some legal experts say is somewhat disturbing in light of a changing timeline and changing molestation charges. In a FindLaw.com article, Jonna Spilbor points out the fact that prosecutors often throw in this charge as a way to get leverage or get evidence that they lack. She also says that Jackson not actually being charged with what he’s alleged to have conspired to do—child abduction, false imprisonment, and extortion—is telling as well:"Stranger still, is that Jackson has not been indicted on the actual objects of the conspiracy itself. In other words, the crimes of Child Abduction, False Imprisonment and Extortion are not charged as stand-alone crimes -- nor are they even charged as attempted crimes. What is really going on here? Perhaps the missing charges mean the grand jury refused to indict despite the evidence presented. Or, perhaps prosecutors were not able to present the grand jury with evidence to support the missing charges -- because supposed co-conspirators in Jackson's entourage would not, or did not, testify against him. Perhaps no such evidence exists, and the entourage is telling the truth after all." (see article)More specifically, Spilbor notes that had the prosecution knew exactly of this being the case, the indictment would have read differently:"Meanwhile, another potential problem with the conspiracy is indicated by the fact that the conspiracy count is written like a multiple-choice quiz. Typically, a prosecutor who believed a conspiracy had these objects might charge them this way: one count of "Conspiracy to Commit Child Abduction," one count of "Conspiracy to Commit False Imprisonment," and one count of "Conspiracy to Commit Extortion." Charging a single count but including three possible objectives may suggest that the prosecutor's knowledge of the conspiracy is limited, and that he is hoping the evidence will support at least one of these alleged objects. "Multiple-choice conspiracy allegations? Changing timeline? Changing charges? Ridiculous. And what's worse, sources say, a number of people have been trying to warn the prosecution to the fact that they could be setting themselves up for a major fall by pursuing this "case" and specifically these alleged abduction/hostage/conspiracy charges.The attorney for two of the rumored alleged co-conspirators, Joe Tacopina, has said repeatedly that his clients are completely innocent of these allegations. He has also mentioned the existence of a number of documents and other evidence that will “shred” the conspiracy charge and the allegations. Tacopina appeared on ABC’s Good Morning America April 12 2004 and spoke to Cynthia McFadden. He said his clients are innocent and neither one has any knowledge at all of Jackson giving alcohol to any minor. When asked if one of his clients, Frank Tyson, threatened the brother of the accuser as alleged, Tacopina says:"Oh god, absolutely not. Frank Tyson’s one of the most passive individuals you’ve ever come across. I don’t think he could get those words out, number one. And number two, he has no, absolutely no knowledge of Michael giving alcohol to any minor at all. And he would know." (see article)Tyson has known Jackson since at least the age of 15, so he would be in a position to know this information. As a matter of fact, Tacopina says if they were even asked by Jackson or anyone else to be involved in a conspiracy or to threaten the accusing family, they wouldn’t. The attorney told McFadden that the accuser’s mother was ridiculed by her friends as a result of the Bashir documents and ran to Jackson seeking refuge:"…Here’s a woman who, after this documentary hit the air, was ridiculed by her friends; was mocked, was called a bad mother. She wanted to get out of her community. She turned to Michael Jackson for help and his generosity, and you know, played on it."Tacopina also questioned the prosecutors and their investigators’ ability to be impartial when looking for the truth in this “case”. He told Rita Cosby (Fox News Live) on April 18:"I do not see the investigators, the prosecutors in this case, going in with an open mind. I think they believe in their theory of the case whatever that theory is gonna be. I don’t think any witness is gonna take them off that theory. I know what Frank Tyson and Vincent Amen would say would take them [prosecutors] off their theory. They support Michael Jackson’s innocence. They have issues with the mother of this alleged victim." (see article)He denied, again, that his clients were in any way involved in the ever-changing tales told by this accusing family. He also says he would have a “picnic” if he had to go out and meet these charges head on with his clients:"I wish I really wish, Rita, I could try my case right here. I wish I could expose all the evidence I know about. I will have a picnic, quite frankly. It would be my pleasure to go out and meet these types of charges if they’re ever levied. They are ludicrous. I know that there’s absolutely no credible evidence that will sustain those charges against Frank and Vinnie. They did nothing against her will. Anything she got, she got ‘cause she wanted it. She had a certain agenda quite frankly. And to now go and implicate my clients at this late date, we’re not gonna stand for it. Fortunately, we don’t have to answer for it now. But if there should come a time when we’re asked to speak our peace in front of a trial jury, we’ll be more than happy to accommodate the accuser."Tacopina also appeared on The Abrams Report April 22 saying that the evidence his clients have will shatter any notion that they had anything to do with kidnapping or threatening these accusers:"If I have to answer these charges for my clients or client, Dan, I am so confident that we will—and I don‘t mean to sound cavalier, because I‘m not taking this lightly. But I‘m so confident that we will shatter the notion that Frank or Vincent did anything wrong. I‘m not only confident based on my conversation with my clients, based on witness conversations, but there are documents out there that will absolutely shred these allegations." (see article)Continuing the public warnings that the prosecution is seriously barking up the wrong tree by going after this “conspiracy” nonsense, Tacopina talked to Debra Norville April 30 2004. He says the district attorney has his position set in stone and says he definitely wasn’t gong to give the prosecution a “sneak preview” of their defense during the one-sided grand jury proceeding:"A grand jury is a one-sided proceeding. In my opinion, the district attorney in this case, you know, sort of had his position set in stone. And I don‘t think, quite frankly, my clients going in there giving them a sneak preview of what our defense will be, if, in fact, they‘re charged, would really bode well for them down the road. If we‘re invited into this foray, if these two really terrific young kids, who are very intelligent, sweet people, are dragged into this mix, I will do everything in my power to make sure that the person who made that decision will regret it and regret it good. "Whether or not the prosecution decides to come to its senses and investigate the family making the allegations remains to be seen, but is unlikely at this point. More likely than not, they will decide to run head-on into a brick (bed rock? graphite? dimond?) wall that Tacopina and others have previously tried to warn them against. -MJEOL
